The above does not apply to SMS opt-in data and consent; text messaging originator opt-in data and consent information will not be shared with any third parties for their own marketing purposes.

We may disclose your information as required by law or in response to subpoenas, court orders, or other legal processes; requests from government authorities or law enforcement agencies; or other legal obligations to comply with applicable laws and regulations.

4.1 Consent to Receive SMS Messages
By providing your mobile phone number and opting in to receive SMS messages from BACKINFIVE — whether through our website, checkout process, or other opt-in mechanism — you expressly consent to receive recurring automated or manually dialed text messages from us, including marketing messages, order updates, promotional offers, and other business-related communications. Message frequency may vary. Consent to receive marketing text messages is not a condition of any purchase.
4.2 How to Opt In
You may opt in to receive SMS messages by entering your mobile phone number and confirming your consent on our website, by texting a keyword to our designated short code or long code as specified at the point of opt-in, or through other opt-in mechanisms made available through the Services. At the point of opt-in, you will receive confirmation of your enrollment and information about how to opt out.
4.3 How to Opt Out
You may opt out of receiving SMS messages from us at any time by replying STOP to any text message you receive from us. After texting STOP, you will receive a final confirmation message confirming your opt-out. You will then no longer receive marketing text messages from us, though we may still send you non-marketing transactional messages related to your orders or account if required. 4.5 No Sharing of SMS Consent
Your opt-in consent to receive SMS messages from BACKINFIVE will not be shared with or sold to any third party for their own marketing purposes. Text messaging originator opt-in data and consent information will not be shared with any third parties. SMS consent data is used solely to communicate with you on behalf of BACKINFIVE.
4.6 Abandoned Cart SMS
Our website uses cookies and similar tracking technologies to help keep track of items you place in your shopping cart, including when you have abandoned your cart without completing a purchase. If you have opted in to receive SMS messages from us, this information may be used to determine when to send cart reminder messages to you via SMS. You may opt out of these messages at any time as described in Section 4.3.
5. DATA SECURITY AND RETENTION
5.1 Security Measures
We implement industry-standard technical, administrative, and physical safeguards to protect your personal information from unauthorized access, disclosure, alteration, or destruction. Our security measures include SSL/TLS encryption for data transmitted between your browser and our servers; PCI-DSS compliant payment processing through third-party processors with no storage of complete credit card numbers; access controls limiting access to personal information to authorized personnel who need it to perform their duties; and regular review and updating of our security practices.

6. RELATIONSHIP WITH SHOPIFY
The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve those Services. Information you submit through the Services will be transmitted to and shared with Shopify, as well as third parties that may be located in countries other than where you reside.
In addition, we use certain Shopify enhanced features that incorporate data from your interactions with our store, other merchants, and with Shopify. To provide these features, Shopify may process personal information collected about your interactions with our store alongside data from other merchants. In these circumstances, Shopify is independently responsible for the processing of your personal information for those purposes, including responding to your requests to exercise your rights.

The Services are not intended for use by children.
