REGULATORY COMPLIANCE
This document outlines the regulatory compliance, safety standards, and limitations of liability associated with BACKINFIVE LLC ("Company," "we," "us," or "our") motorized window shade products ("Products"). By purchasing, installing, or using our Products, you ("Customer," "you," or "your") acknowledge and agree to the terms set forth herein.
BACKINFIVE is committed to manufacturing and distributing Products that comply with all applicable U.S. federal, state, and local laws and regulations. Our Products meet or exceed the following standards:
1.1 Electrical and Product Safety Standards
UL (Underwriters Laboratories) Compliance:
- Our motorized shade systems and components comply with applicable UL safety standards for low-voltage electrical products
- Motors, batteries, and charging systems are designed to operate safely within specified voltage and current parameters
- Products undergo testing to ensure they do not pose electrical shock, fire, or thermal hazards under normal use
Consumer Product Safety Improvement Act (CPSIA):
- Our Products comply with CPSIA requirements, including limits on lead content and phthalates in materials accessible to children
- Products are free from banned hazardous substances as defined by the CPSC
1.2 Wireless and Radio Frequency Compliance
FCC (Federal Communications Commission) Compliance:
- Remote controls, wireless wall switches, and smart home connectivity features comply with FCC regulations for radio frequency devices under Part 15 of the FCC Rules
- Our Products have been tested and found to comply with limits for Class B digital devices, which are designed to provide reasonable protection against harmful interference in residential installations
- Products operate within authorized frequency bands and do not cause harmful interference to other devices
FCC Disclaimer: This device complies with Part 15 of the FCC Rules. Operation is subject to the following two conditions:
- This device may not cause harmful interference.
- This device must accept any interference received, including interference that may cause undesired operation.
Note: Changes or modifications not expressly approved by BACKINFIVE may void the user's authority to operate the equipment.
1.3 Child Safety and Window Covering Standards
ANSI/WCMA A100.1 Standard:
- Our motorized shades comply with the American National Standards Institute (ANSI) and Window Covering Manufacturers Association (WCMA) Standard for Safety of Corded Window Covering Products (ANSI/WCMA A100.1)
- All Products are designed with cordless operation to eliminate strangulation hazards associated with accessible cords, chains, or loops
CPSC (Consumer Product Safety Commission) Guidelines:
- Products adhere to CPSC guidelines for the safe design of window coverings to prevent child injuries and fatalities
- We comply with voluntary industry standards and best practices for child-safe window treatments
1.4 Environmental and Material Safety Compliance
California Proposition 65:
- Our Products comply with California Proposition 65 (Safe Drinking Water and Toxic Enforcement Act of 1986), which requires warnings for products containing chemicals known to cause cancer, birth defects, or reproductive harm
- While our Products do not intentionally contain Proposition 65-listed chemicals at levels requiring warnings, some components (e.g., batteries, electronic circuits) may contain trace amounts of regulated substances
RoHS (Restriction of Hazardous Substances):
- Electronic components in our Products comply with RoHS directives limiting the use of hazardous materials such as lead, mercury, cadmium, and certain flame retardants
1.5 Battery Safety and Compliance
Lithium-Ion Battery Regulations:
- Rechargeable lithium-ion batteries used in our Products comply with UN38.3 (United Nations Manual of Tests and Criteria) for safe transport and handling
- Batteries are designed with overcharge protection, short-circuit protection, and thermal management systems to prevent fire or explosion hazards
- Customers must follow all battery safety instructions provided with the Products
Shipping Compliance:
- Products containing lithium-ion batteries are shipped in accordance with Department of Transportation (DOT) and International Air Transport Association (IATA) regulations for dangerous goods
2. INTENDED USE AND LIMITATIONS
2.1 Residential Use Only
BACKINFIVE motorized shades are designed and intended for residential use only. Products are not approved or warranted for:
- Commercial, industrial, or institutional applications
- High-traffic environments (e.g., hotels, offices, hospitals, schools)
- Outdoor or harsh environmental conditions (extreme temperatures, high humidity, saltwater exposure)
- Applications involving continuous or heavy-duty operation beyond normal residential use
2.2 Installation Requirements
Products must be installed in accordance with the provided installation instructions. Proper installation is essential for safe and reliable operation. Failure to follow installation instructions may result in:
- Product malfunction or failure
- Injury or property damage
- Voiding of warranty
2.3 Environmental Limitations
Products are designed for use in climate-controlled indoor residential environments. Do not use Products in:
- Outdoor or semi-outdoor locations exposed to rain, snow, or extreme weather
- Areas with excessive moisture (e.g., bathrooms with poor ventilation, saunas, indoor pools)
- Environments with extreme temperatures (below 32°F / 0°C or above 110°F / 43°C)
- Areas exposed to corrosive chemicals, salt spray, or industrial pollutants
3. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE FOLLOWING LIMITATIONS OF LIABILITY APPLY:
3.1 Disclaimer of Warranties
EXCEPT AS EXPRESSLY PROVIDED IN OUR LIMITED WARRANTY, BACKINFIVE MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE PRODUCTS, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY: We do not warrant that the Products are suitable for any particular purpose beyond their intended residential use.
- IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE: We do not warrant that the Products will meet your specific requirements or expectations.
- NON-INFRINGEMENT: We do not warrant that the use of our Products will not infringe on third-party intellectual property rights.
AS-IS DISCLAIMER: EXCEPT AS EXPRESSLY STATED IN OUR LIMITED WARRANTY, ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND.
3.2 Exclusion of Consequential and Incidental Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BACKINFIVE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, or business opportunities
- Loss of data or information
- Loss of use of Products or related equipment
- Cost of substitute or replacement goods or services
- Property damage to real or personal property (excluding damage directly caused by product defects covered under warranty)
- Personal injury or wrongful death (except as caused by our gross negligence or willful misconduct)
- Emotional distress, mental anguish, or pain and suffering
- Damage to reputation or goodwill
THESE LIMITATIONS APPLY EVEN IF BACKINFIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF THE LEGAL THEORY UPON WHICH LIABILITY IS BASED (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE).
3.3 Maximum Liability Cap
IN NO EVENT SHALL BACKINFIVE'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE PRODUCTS, THEIR PURCHASE, INSTALLATION, OR USE EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.
This limitation applies regardless of the number of claims or causes of action asserted and regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise).
3.4 Exceptions to Limitations
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages or certain implied warranties. In such jurisdictions, the above limitations may not apply to you, and our liability shall be limited to the greatest extent permitted by applicable law.
Nothing in this document shall exclude or limit liability for:
- Death or personal injury caused by BACKINFIVE's gross negligence or willful misconduct
- Fraud or fraudulent misrepresentation
- Any other liability that cannot be excluded or limited under applicable law
4. USER RESPONSIBILITIES AND ASSUMPTION OF RISK
4.1 Proper Installation
You are responsible for ensuring that Products are installed correctly and safely in accordance with the provided instructions. Improper installation may result in:
- Product malfunction, damage, or failure
- Injury to persons or damage to property
- Voiding of warranty
If you are not confident in your ability to install the Products safely, we recommend hiring a qualified professional installer.
4.2 Safe Use and Operation
You are responsible for:
- Using Products only for their intended residential purpose
- Following all safety warnings, instructions, and guidelines provided with the Products
- Supervising children and pets near motorized shades to prevent accidents
- Keeping remote controls, charging cables, and accessories out of reach of young children
- Regularly inspecting Products for signs of wear, damage, or malfunction
4.3 Maintenance and Care
You are responsible for:
- Performing routine maintenance as recommended in the product manual (e.g., cleaning fabrics, checking battery charge levels)
- Promptly addressing any signs of malfunction or damage
- Replacing batteries and consumable components as needed
- Discontinuing use of Products that are damaged or not functioning properly
4.4 Compliance with Local Laws
You are responsible for ensuring that the installation and use of Products comply with all applicable local building codes, electrical codes, safety regulations, and homeowner association rules.
4.5 Assumption of Risk
By purchasing and using BACKINFIVE Products, you assume all risks associated with:
- Improper installation or use
- Failure to follow instructions or safety guidelines
- Use of Products in environments or applications for which they are not designed
- Acts or omissions of third-party installers or service providers
5. THIRD-PARTY PRODUCTS AND SERVICES
5.1 Installation Services
BACKINFIVE may provide referrals or recommendations for third-party installation service providers. These providers are independent contractors and are not employees, agents, or representatives of BACKINFIVE.
WE DO NOT GUARANTEE, WARRANT, OR ASSUME ANY LIABILITY FOR:
- The quality, timeliness, or safety of third-party installation services
- Acts, omissions, negligence, or misconduct of third-party installers
- Damage to property or injury to persons caused by third-party installers
Any agreements, disputes, or claims arising from third-party installation services are solely between you and the service provider. You agree to indemnify and hold BACKINFIVE harmless from any claims related to third-party installation services.
5.2 Smart Home Integration
Our Products are designed to integrate with third-party smart home platforms (e.g., Apple Home, Amazon Alexa, Google Assistant, Samsung SmartThings). These platforms are operated by third parties and are not controlled by BACKINFIVE.
WE DO NOT GUARANTEE:
- Compatibility with all smart home platforms or devices
- Continued support for third-party platforms (platform providers may change or discontinue features at any time)
- The security, privacy, or reliability of third-party platforms
Your use of third-party smart home platforms is subject to the terms and privacy policies of those platforms. BACKINFIVE is not responsible for any issues arising from the use of third-party platforms.
5.3 Third-Party Components
Our Products may contain components manufactured by third parties (e.g., motors, batteries, electronic controllers). While we select high-quality components, we do not control the manufacturing processes or quality standards of third-party suppliers.
BACKINFIVE IS NOT LIABLE FOR:
- Defects or failures caused by third-party components, except as covered under our limited warranty
- Recalls or safety issues related to third-party components (we will cooperate with recall efforts and notify affected customers)
6. FORCE MAJEURE
BACKINFIVE shall not be held liable for any failure or delay in performance of its obligations under these terms due to circumstances beyond its reasonable control, including but not limited to:
- Acts of God (earthquakes, floods, hurricanes, tornadoes, wildfires, pandemics)
- War, terrorism, civil unrest, or government actions
- Labor disputes, strikes, or lockouts
- Supply chain disruptions, shortages of materials, or manufacturing delays
- Failures of third-party suppliers, carriers, or service providers
- Cyberattacks, data breaches, or IT system failures
- Utility outages (power, internet, telecommunications)
- Changes in laws, regulations, or trade policies
In the event of a force majeure event, our obligations will be suspended for the duration of the event, and delivery times may be extended accordingly.
7. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless BACKINFIVE LLC, its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees and court costs) arising from or related to:
- Your use, misuse, or improper installation of Products
- Your violation of these terms or any applicable laws or regulations
- Your violation of any rights of a third party
- Inaccurate information provided by you during the ordering or installation process
- Acts or omissions of third-party installers or service providers engaged by you
- Injuries or damages caused by your failure to follow safety instructions or warnings
- Negligent, reckless, or intentional conduct by you or anyone using your Products
8. MODIFICATION OF PRODUCTS
8.1 Prohibition on Unauthorized Modifications
You may not modify, alter, disassemble, reverse-engineer, or tamper with BACKINFIVE Products or their components. Unauthorized modifications may:
- Create safety hazards (electrical shock, fire, mechanical failure)
- Void the warranty
- Violate regulatory compliance (e.g., FCC certification)
- Result in liability for damages or injuries
8.2 Repairs and Replacement Parts
Repairs and replacement parts must be obtained from BACKINFIVE or authorized service providers. Use of non-genuine or incompatible parts may compromise safety and performance and will void the warranty.
9. INTELLECTUAL PROPERTY INFRINGEMENT
BACKINFIVE respects the intellectual property rights of others and expects customers to do the same. If you believe that any BACKINFIVE Product infringes your intellectual property rights, please contact us at support@backinfive.com with the following information:
- Identification of the intellectual property claimed to be infringed
- Description of where the alleged infringement is located
- Your contact information
- A statement that you have a good faith belief that the use is not authorized
- A statement that the information in your notice is accurate and that you are the rights holder or authorized to act on behalf of the rights holder
We will investigate claims and take appropriate action in accordance with applicable law.
10. SEVERABILITY
If any provision of this document is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
11. GOVERNING LAW AND JURISDICTION
This document and any disputes arising out of or related to the Products shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
Any legal action or proceeding arising out of or related to this document or the Products shall be brought exclusively in the state or federal courts located in San Mateo County, California and you consent to the personal jurisdiction of such courts.

BY PURCHASING, INSTALLING, OR USING BACKINFIVE PRODUCTS, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO THE TERMS SET FORTH IN THIS DOCUMENT, INCLUDING ALL LIMITATIONS OF LIABILITY AND DISCLAIMERS.
